1 Scope
These Terms of Use apply to:
all orders, purchases, or other acquisitions related to:
a) products, applications, and services provided directly by LispApp;
your LispApp account and its creation;
the use of and/or access to:
a) all products, services, applications, and user-generated content;
b) embedded devices, unless governed by the terms of the relevant third-party manufacturer;
the copying, use of, and/or access to your user data.
Use of Recordings
The application may utilize user-generated recordings that cannot be linked to an individual user. These anonymized recordings may be used for service development, research, AI training, and marketing support.
The user agrees that LispApp may use such non-identifiable recordings for the above-mentioned purposes without separate consent.
(i) By placing an order, purchasing, or otherwise acquiring a product, service, or application, and (ii) by using or accessing any environment, service, or application, and/or (iii) by creating an account, you accept these Terms of Use.
2 Order directly through LispApp
This section explains how you can order a product and/or service directly from LispApp, how payment is made, and how the purchase is delivered to you.
2.1. Placing an order
LispApp's products include app services and remote therapy through LispApp's websites, areas, and apps. These products and services may contain or consist of LispApp content and third-party material.
When you want to order, purchase or otherwise obtain a product or service directly from LispApp, you can place your order through the platform, the LispApp website, or the app.
2.2. Price and payment
Some products and services are subject to a fee. The prices of products and/or services displayed on the LispApp website and apps include VAT.
All orders must be paid through the payment service provided by LispApp. In order to place orders and use this payment service, you must provide the details of your chosen payment method.
3 Your account and subscription
The following activities may require you to create an LispApp account: purchase a product or service; use a service, application, and/or user-generated content; manage your own user data and/or user-generated content. This section explains the rights and obligations relating to your account and subscription. It also tells you how you can or how LispApp may terminate your account or subscription.
3.1 Your account: registration and management
You may be asked to create an account and then log in to the corresponding area to
i. order a product or service,
ii. access the service, app, and/or user-generated content (obtained directly from LispApp or the speech therapist), and
iii. upload user data and/or user-generated content to and/or from the server.
iv. manage your account and/or orders.
Please notify LispApp immediately if you discover that third parties are using your account services, applications, user data, and/or user-generated content without your permission or that security measures have been breached.
3.2 Subscriptions, renewals, and free trials
Services can be provided on an individual or subscription basis. Where there is a subscription fee, the service is provided either on a monthly or fixed-term basis. Paid monthly subscriptions are valid indefinitely, and the associated fees and applicable taxes will be automatically charged by your preferred payment method at the beginning of each subscription period unless you cancel your monthly subscription before the subscription period automatically renews. Subscriptions are valid until further notice unless you have agreed with LispApp on a fixed-term subscription.
In addition, LispApp may from time to time, at its discretion, offer a free or discounted trial subscription to a paid monthly subscription or fixed term subscription ("Trial Subscription").
If you wish to take advantage of a free trial, LispApp will ask you to provide your preferred payment method. By submitting your payment details and activating the trial, you agree that LispApp may automatically charge you for a paid subscription (monthly or recurring) starting the day after the trial ends. You will be clearly and explicitly informed of this before the trial begins.
You will receive advance notice of the applicable price, billing cycle, and other essential terms of the paid subscription. You can cancel your subscription at any time before the trial ends at no cost.
You can check your subscription details at lispapp.com using your LispApp account email address and password.
3.3 Closing your account and/or terminating your subscription
You can cancel a paid monthly subscription without giving a reason at any time before the start of each new subscription period or the end of the trial subscription period. The cancellation will take effect at the end of the billing cycle or trial subscription period. Partial monthly payments are not refundable.
If you want to terminate orders you have purchased through LispApp, you must log in to lispapp.com with your LispApp account email address and password. You can cancel your subscription to expire by the last day of the paid subscription period.
If you decide to unsubscribe from a paid app and a "free version" of the app is available, you can continue to use that free version unless you uninstall the app from your device.
If you would like us to delete your LispApp account, please contact our customer service.
4 Closure and restrictions if you are in breach of contract
ÄrräTreeni reserves the right to suspend or terminate your account and/or subscription, delete your profile and user data, or restrict your access to services if:
- you materially breach these Terms of Use; or
- payment for your services and/or subscriptions has not been received on time.
In such cases, ÄrräTreeni may act immediately at its own discretion without prior notice. However, ÄrräTreeni will strive to notify you by email about the suspension or restriction when reasonably possible.
5 Force majeure
This section explains the special circumstances in which ÄrräTreeni is legally released from its contractual obligations.
Force majeure means circumstances that prevent ÄrräTreeni from fulfilling its obligations under these Terms of Use when ÄrräTreeni cannot reasonably be expected to do so, including late and/or delayed or incomplete deliveries by ÄrräTreeni, temporary or partial disabling of your account, services, applications, user data and/or user-generated content due to circumstances beyond ÄrräTreeni's reasonable control. In a force majeure situation, all obligations of ÄrräTreeni are suspended temporarily. However, this does not limit your statutory consumer rights, such as the right to a refund if the agreed delivery is not fulfilled within a reasonable time.
6 Privacy policy
This section explains how personal data (e.g. name, address, email address, phone number) of users of LispApp's products, services, and applications are used and processed.
LispApp must use your email address to deliver products and services. LispApp is subject to European Union and other local data protection laws. Therefore, LispApp will only use your information for the purpose and for the duration for which it was obtained. You can find our applicable privacy statement at: lispapp.com/privacy-policy
7 Third-party rights
Third parties have no rights under applicable law to rely on or enforce these Terms and Conditions, but this does not affect any rights or remedies of a third party that exist or are available in addition to such applicable law.
8 Changes
LispApp reserves the right to make changes and additions to these Terms and Conditions at any time.
9 Entire agreement
These Terms and Conditions (including any additions and changes that are provided in the product packaging) and any other Terms and Conditions constitute the entire agreement between you and LispApp with respect to the Products, including any support services, services, applications, user data and/or user-generated content that may be included with the Products. These Terms and Conditions take precedence over all prior or contemporaneous oral or written communications, proposals, and submissions regarding the Software or any other subject matter covered by these Terms and Conditions. In the event that any LispApp support services guidelines or programs conflict with the terms of these Terms and Conditions, these Terms and Conditions will govern. If any provision of these Terms and Conditions is deemed invalid, void, unenforceable, or illegal, the remaining provisions shall remain in full force and effect.
10 Removability
If any of these Terms and Conditions is deemed invalid, void, unenforceable, or illegal, all other provisions shall remain in full force and effect and enforceable. If a term of use is deemed invalid, LispApp will replace it with a new one. These new Terms and Conditions will be interpreted as closely as possible to the wording of the original text in terms of content and effects, but in such a way that rights can actually be derived from them.
11 Applicable law and competent court
These Terms and Conditions and all disputes relating to them and the purchase and use of products, services, applications, user data, and user-generated content, or any other disputes that may arise, shall be governed by Finnish law. The Finnish courts shall have exclusive jurisdiction to settle any disputes or claims (including non-contractual disputes or claims) relating to these Terms and Conditions. This clause does not affect your rights under local mandatory law, including your right (where applicable) to bring any dispute or claim arising out of these Terms and Conditions before the courts in your jurisdiction of domicile or other courts having jurisdiction over such disputes.

LispApp will carefully examine your email, and deal with all complaints as quickly as possible.
